1. Who we are
Daily Profit Accelerator ("the Platform") is an online education and training program operated by Upward Momentum LLC ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Platform, including the 15-Day Challenge, member back office, digital products, coaching sessions and the partner program. By creating an account or purchasing any product, you agree to these Terms.
2. What you are buying
The Platform sells education: structured training content, worksheets, templates, community features and access to success coaches. We do not sell a business opportunity, a franchise, or an investment. Purchasing any program does not guarantee income or results of any kind. See our Earnings Disclaimer.
3. Accounts
- You must be at least 18 years old to create an account.
- You are responsible for your login credentials and all activity under your account.
- One account per person; accounts are not transferable.
- We may suspend or terminate accounts that violate these Terms.
4. Payments and billing
Prices are shown at checkout in US dollars. Payments are processed by third-party payment processors; we do not store your full card details. Some products are one-time purchases; any subscription products renew automatically until cancelled. Refunds are governed by our Refund Policy.
5. Coaching sessions
Certain program features, including access to Days 5-15 of the challenge, are connected to a scheduled call with a success coach. This structure is disclosed before purchase. Success coaches may receive compensation on program enrollments. Coaches provide education and accountability - they do not provide financial, legal, tax or investment advice.
6. Partner program
Members may apply to participate in our affiliate partner program. Participation is governed by the separate Affiliate Agreement signed inside the Platform. Commissions are earned only on real product sales - never for recruiting or enrollment. Partners are independent contractors, not employees or agents of Upward Momentum LLC.
7. Intellectual property
All Platform content - videos, worksheets, templates, copy, design and code - is owned by Upward Momentum LLC or its licensors. Your purchase grants a personal, non-transferable, non-exclusive license to use the content for your own education. You may not resell, redistribute, record, or share content or account access.
8. Acceptable use
- No unlawful, deceptive or fraudulent activity.
- No spam or misleading claims when sharing your partner link - income claims must comply with our Earnings Disclaimer and applicable law.
- No scraping, reverse engineering, or interfering with the Platform.
- No harassment of members, coaches or staff.
9. Disclaimers
The Platform is provided "as is" without warranties of any kind. Nothing on the Platform is financial, investment, legal or tax advice. Results shown are individual experiences and are not typical; most participants earn little or nothing.
10. Limitation of liability
To the maximum extent permitted by law, Upward Momentum LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits, arising from your use of the Platform. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
11. Termination
You may close your account at any time. We may suspend or terminate access for violation of these Terms; earned partner commissions on legitimate sales survive termination per the Affiliate Agreement.
12. Changes
We may update these Terms from time to time. Material changes will be posted on this page with a new effective date; continued use of the Platform after changes means you accept them.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Hillsborough County, Florida.
